Fair Labor Standards Act

The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay, record keeping, and youth employment standards affecting employees in the private sector and in Federal, State, and local governments. Non-exempt employees must receive overtime pay for hours worked over 40 per workweek at a rate not less than one and one-half times the regular rate of pay.  

Timesheets

Employees who are nonexempt from the Fair Labor Standards act must complete a timesheet for all hours worked including paid leave.It is imperative that timesheets are completed in Workday each pay period to ensure you are paid in a timely manner, and to avoid disruption to your benefits coverage.  

Compensatory Time

Employees may elect to receive compensatory time in lieu of cash payment for any hours worked over 40 in a workweek (UPD officers have special rules regarding compensatory time found in their collective bargaining agreement). Employees receive 1.5 hours of compensatory time for each hour worked over 40 hours in a workweek. Employees must complete Overtime/Compensatory Time Agreement in Workday in order to receive compensatory time. Otherwise you will receive cash payment for your overtime.  

Travel

Determining overtime pay as it is related to travel can be tricky. Please review theFLSA Traveldocument to learn about under what circumstances time spent traveling is considered compensable. 

Meal Periods

UNF’s practice is for non-exempt employees to have an established work schedule and meal period. If your approved work schedule includes a lunch break, the lunch break must be at least 30 minutes in duration. As a reminder, non-exempt employees must record all hours worked on their timesheet. For example, if you work 8:30 a.m. -11:30 a.m., take 30 minutes for lunch, work 12:00 p.m.-5:00 p.m. – you would record eight hours worked on your timesheet for this day.
