(ARTICLE 10: ACADEMIC FREEDOM AND RESPONSIBILITY)
Whereas, "academic freedom" is codified in Article 10 of the UNF-UFF Collective Bargaining Agreement;
Whereas that article states that "Neither the University Administration nor its representatives shall apply any provision in this Agreement in such a way as to violate any faculty member's academic freedom or to penalize a faculty member for the legitimate exercise of academic freedom" and that "The University Administration shall protect members of the faculty against infringement of their academic freedom."
Whereas the Collective Bargaining Agreement also states that "Faculty shall have freedom to present ideas and discuss, frankly and in a forthright manner, academic policy, University governance, or other matters pertaining to the University."
Whereas, rigorous debate concerning all curricular matters is covered by the Collective Bargaining Agreement's article on Academic Freedom;
Whereas, there is no limit in the Collective Bargaining Agreement on the amount of such debate or the number or kind of venues in which such debate occurs;
Whereas, the free and unfettered exercise of academic freedom cannot constitute an act of obstruction and incivility;
Therefore, be it resolved, that any advancement of a claim of incivility against a faculty member by another faculty member or anyone in the supervisory chain above that faculty member, when that claim causes harm to the reputation or evaluations of that faculty member, itself constitutes an intolerable act of incivility.
