QUESTION SYNOPSIS
With the expiration of the contract, which mandates collegiality,
will the administration no longer be able to take disciplinary action
against faculty whom it deems uncollegial?
What is included under the definition of "misconduct" for
just cause for termination?
In the Florida Trend magazine, UNF tied with UF for highest student-teacher
ratio. Is UNF's claim to offer better ratios not true?
(Written follow-up) I am not inquiring into the permeative
properties and penumbras
of collegiality as they may pertain to the many dimensions constituting
the academic organism. I am asking a legal question: Section 4 of
Article 5 of the Contract, which mandates collegiality, is not included
in the corresponding Chapter 10 of the Faculty Handbook. Does this
mean that with the expiration of the Contract next month that
the administration will no longer have the authority to take disciplinary
action against faculty whom it deems uncollegial? If the administration
will have this authority,
what will be the legal justification for it? The background to this
is that the "collegiality clause," as it is called, was
added to the contract only several years ago. Prior to that, there
was no provision for the administration to discipline faculty for
uncollegiality.
