Sustained Performance
Evaluation Appeals If disagreements occur in the process or outcomes of a Sustained Performance Evaluation, the following appeals are possible: a) If a department chair and a Department SPE Oversight Committee cannot agree on the ratings assigned to a faculty member, the case shall automatically be referred to the Dean, within five working days of the notice of disagreement; if either the chair or the Committee disagree with the Dean's determination, they may appeal to the Provost, within five working days of the notice of disagreement. b) If a faculty member disagrees that s/he should be evaluated at the "below satisfactory" level and needs a Performance Improvement Plan, an appeal may be directed to the Dean, within five working days of the notice of the evaluation outcome; if denied at that level, appeals may be directed to the Provost, within five working days of the notice of denial. c) In cases in which the faculty member disagrees with an evaluation of "satisfactory" (rather than "outstanding"), an appeal may be directed to the Faculty SPE Appeals Committee, within five working days of the notice of the evaluation outcome. d) For cases in which the faculty member and department chair cannot agree on the components of a Performance Improvement Plan, the faculty member may appeal to the Faculty SPE Appeals Committee, within five working days of the declaration of impasse. All appeals which are directed to the Faculty SPE Appeals Committee shall be submitted through the Faculty Association President, who shall have the responsibility for convening the Committee as needed. The Committee will elect its own chair after being convened for the first time each Fall semester. Eleven full-time, tenured faculty at the associate level or above, who do not have line authority over promotion and/or tenure decisions, shall constitute the Faculty SPE Appeals Committee. Membership of the committee shall be composed of one representative from each college selected by the college faculty from among its tenured professors at the associate level or above, plus six (6) at-large representatives elected by the Faculty Association. No faculty member who is subject to a Performance Improvement Plan shall be permitted to sit on the Faculty SPE Appeals Committee. The term of office on this Committee shall be staggered two-year terms, beginning in the Fall semester each year. In the initial year of operation, the President of the Faculty Association shall identify the process by which staggered terms are accomplished.
