I. OBJECTIVE & PURPOSE

To establish a policy to ensure compliance with campus safety and security reporting requirements as outlined in the Higher Education Opportunity Act. Specifically the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, 20 U.S.C. § 1092(f) (“Clery Act”), and Section 304 (“Campus SaVE Act”) of the Violence Against Women Act (collectively referred to as “the Acts”),

II. STATEMENT OF POLICY


The Acts require institutions of higher education to take certain actions to ensure compliance with respect to campus safety and security reporting. This policy and related procedures provide specific information regarding those requirements and the offices/departments which are charged with the responsibility for ensuring compliance.

To report a crime:

Contact the University of North Florida Police (UNFPD) at (904)620-2800 (non-emergencies), dial 911 (emergencies only), or by using the Code Blue telephones located in the residence halls, parking lots, and buildings throughout campus. Any suspicious activity or person seen in the parking lots or loitering around vehicles, inside buildings, or around the residence halls should be reported to the UNFPD. An individual may report a crime confidentially by using the Silent Witness Form located on the UNFPD website at http://www.unf.edu/upd/. Additionally, if an individual does not wish to contact UNFPD directly, he/she is encouraged to report the crime to a campus security authority (CSA), listed in Appendix A below.

III. STATEMENT OF PROCEDURE

As part of ongoing efforts for campus safety and security and in implementing the legal requirements of the Clery Act the University will:

Issue an Annual Security Report (“ASR”) – no later than October 1 of each year. Publish an annual security report containing campus policy disclosures and crime statistics. The UNFPD is responsible for compiling the information necessary for the report. A more detailed list of the policy statements and other information that must be contained in the annual security report can be found on UPD’s website, http://www.unf.edu/upd/ under the Clery Act Reporting tab.

1. Provide notice regarding the availability of the annual security report to current and prospective employees – Responsible Department/Unit: Office of Human Resources. The notice should include:

A. A statement of its contents.
B. A list and/or brief description of the information contained in the report.
C. If posted on the web, the exact URL where the report may be accessed.
D. A statement that a hard copy of the report will be provided upon request.

2. Provide notice regarding the availability of the annual security report to current and prospective students – Responsible Department/Unit: Enrollment Services. The notice should include:

A. A statement of the report’s availability.
B. A description of its contents.
C. If posted on the web, the exact URL where the report may be accessed.
D. A statement that a hard copy of the report will be provided upon request.

Classify and Count Crimes
- Three general categories of crime statistics must be compiled and reported in the Annual Security Report (ASR) and to the U.S. Department of Education (DOE):

- Criminal offenses
- Hate crimes, and;
- Arrests and referrals for certain disciplinary actions.

Gather and Submit Crime Statistics - Each fall as directed by the U.S. Department of Education (DOE). Disclose crime statistics by type, location, and year to the DOE through its web-based data collection process. Responsible Department/Unit: UNFPD. The University must disclose Clery Act crime statistics for all buildings or property that the University owns or controls, domestic or foreign, which are used in direct support of, or in relation to, the institution’s educational purposes. The University will gather crimes statistics from the following geographic locations:

- Campus Property – Any building or property owned or controlled by an institution within the same reasonably contiguous geographic area and used by the institution in direct support of, or in a manner related to, the institution’s educational purpose, including residence halls; and building or property owned by the institution but controlled by another person, that is frequently used by students, and supports institutional purposes (such as food or other retail vendor).

- Non-campus building or property – Any building or property owned or controlled by an institution that is used in direct support of, or in relation to, the institution’s educational purposes, is frequently used by students, and is not within the same reasonably contiguous geographic area of the institution. This category includes certain types of University student travel and other off-campus activity. Building or property is considered non-campus property and thus Clery Act reportable when:
o The University has a written agreement for use and control of the building or property and;
• Students make use of the building or property at least once every year or more frequently, or:
• For short-stay away trips of more than one night at the same location involving student travel.
• Examples include but are not limited to, Hotel stays for International Travel and Athletics’ travel or renting/leasing or using off-campus classroom facilities.
- Public Property – All public property, including thoroughfares, streets, sidewalks, and parking facilities, that are within the campus, or immediately adjacent to and accessible from campus property.

Clery Act Reportable Crimes include:
- Criminal Homicide
- Murder/Non-negligent Manslaughter
- Negligent Manslaughter
- Sex Offenses: rape, fondling, incest and statutory rape

- Robbery
- Aggravated Assault
- Burglary
- Motor Vehicle Theft
- Arson
- Domestic Violence
- Dating Violence
- Stalking
- Hate Crimes include any of the above offenses and any types of larceny-theft, simple assault, intimidation or destruction/damage/vandalism of property that were motivated by bias. Bias categories include: race, gender, gender identity, religion, sexual orientation, ethnicity, national origin and disability.
In addition to the above crimes the University must also report arrests and referrals for disciplinary action for: weapons violations (carrying, possessing, etc.), drug abuse violations and liquor law violations.

(The University must report these crimes in its ASR, however, individuals are urged to report all incidents of criminal activity to UNFPD)

Maintain a Daily Crime Log - A daily record of all alleged crimes and criminal incidents reported to the UNFPD must be maintained including the date, time, location, and nature of the crime, as well as the disposition of the complaint, if known. This log must be accessible and available to the public. Responsible Department/Unit: UNFPD.

Issue Campus Alerts - Responsible Department/Unit: UNFPD. Provide the campus community with information necessary to make informed decisions about their health and safety.

A. Issue a Timely Warning (“Security Alert”) that a campus crime, which represents an ongoing threat to the safety of students and employees, has been committed. For more information see UNF Policy 1.0100P Timely Warning and Emergency Notification Policy.

B. Issue an Emergency Notification upon confirmation of a significant emergency or dangerous situation involving an immediate threat to the health or safety of students or employees. For more information see UNF Policy 1.0100P Timely Warning and Emergency Notification Policy.

Maintain a List of Campus Security Authorities (CSAs)
- A list of individuals who have significant responsibility for student and campus activities and to whom an alleged crime may be reported must be maintained. Responsible Department/Unit: Office of Human Resources. A list of CSAs is included in Appendix A as is information regarding their specific responsibilities. Upon receiving information regarding an alleged crime, a CSA must immediately contact the UNFPD. The UNFPD will, at least twice a year, send an email to the CSA’s identified by title in appendix “A” inquiring if a crime was reported to the CSA that was not reported to the UPD. This email will be completed just prior to the end of the term.

Disclose Fire Safety Information
- Responsible Department/Unit: Housing and Residence Life.
A. Maintain a fire log of all reported fires that occur in on-campus housing facilities. Required fire log elements include:
a. The date and time of the fire.
b. The nature of the fire.
c. The general location of the fire.
d. The date the fire was reported.

B. Publish an annual fire safety report that contains fire safety policies and fire statistics for each on-campus housing facility - no later than October 1 each year.
1. The publication requirements for the fire safety report are the same as those for the annual security report.
2. Required fire statistics include:
a. The number of fires and the cause of each fire.
b. The number of persons who received fire-related injuries requiring treatment as a medical facility, including the Student Health Service.
c. The number of deaths related to a fire.
d. The value of property damage caused by a fire.
C. Submit fire statistics to the DOE annually.

An individual may also connect to the UNFPD website via the UNF Home page at http://www.unf.edu. The ASR is prepared in cooperation with local law enforcement agencies surrounding our main campus and downtown MOCA (Museum of Contemporary Art - A UNF Resource), Housing and Residence Life Services, the Student Conduct Officer, the Division of Student Affairs, and the Office of the General Counsel. Additionally, compliance with the Act and preparation of the ASR are done in collaboration with a presidentially appointed Clery Act Committee. Each entity provides updated information on their educational efforts and programs to comply with the Acts.

Campus crime, arrest, and referral statistics include those incidents reported to the UNFPD, designated campus security authorities listed in Appendix A below, and local law enforcement agencies.

*Many crimes (especially sexual assaults) go unreported to police but may be reported to others. Because of a campus security authority’s involvement with student and campus activities, a student may be more comfortable sharing information regarding a crime with one of the positions listed above than with a member of law enforcement - thus the designation of the position as a Campus Security Authority. A campus security authority's key responsibility is to report to UNFPD all potential crimes that come to their attention. A CSA should advise a victim/witness of the CSA’s responsibility to report crimes and if the victim/witness requests confidentiality, a CSA may withhold the victim/witness’s personally identifiable information when reporting to UNFPD. In all cases, however, a CSA must report potential criminal incidents to UNFPD, regardless of whether the CSA is asked to withhold personally identifiable information. A CSA’s responsibilities DO NOT include investigating criminal incidents or determining whether an incident is actually a crime.

**A person who is licensed or certified as a professional counselor and whose official responsibilities include providing mental health counseling to members of the institution’s community and who is functioning within the scope of their license or certification is exempt from the campus security authority reporting requirements.
